Terms & Conditions

David Wyman Music | Last reviewed: 13 October 2026

Thanks for considering David Wyman Music. These terms explain the general arrangements for my services. The written quote or booking confirmation will set out the particular price, deliverables, timings and permissions for your booking. The separate Refund Policy explains cancellations and refunds in more detail. Nothing here removes rights you have under the Australian Consumer Law.

Services and enquiries

I provide or arrange services including Session Guitar, Composition & Scoring, Music Production, Live Music and online Guitar Lessons. Availability, location, personnel, technical requirements and scope depend on the booking. Sending an enquiry does not reserve a date or oblige you to proceed.

Quotes, bookings and payment

I'll give you the agreed scope, total price, payment dates and important requirements in writing before you commit. I am not registered for GST, so GST is not added to my prices.

Normally, studio sessions, remote recording/composition projects and live performances use a 10% upfront deposit. Online guitar lessons are paid in full before the lesson. For studio recording sessions, the remaining 90% is ordinarily due at the end of the session; for live performances, it is ordinarily due seven days before the event; and for remote projects, it is due at the agreed milestone, normally before final delivery. Larger projects may use agreed stages.

A date or project slot is reserved in my schedule once the applicable quote and terms have been accepted in writing, the required payment has been received and I have sent written booking confirmation. This booking procedure does not override any binding agreement already made under the law. Payment is by bank transfer or, when offered, a secure card-payment provider. I do not add a card-processing surcharge.

Deliverables, creative feedback and timing

The accepted quote determines what is included. For remote session guitar and composition work, finished files and versions are agreed in advance; dry/DI tracks, stems, alternate takes or editable session files are not automatically included. I normally include up to three reasonable, consolidated creative revision rounds within the original brief. Correcting mistakes, supplying something already agreed or providing a legal remedy does not use up those rounds or attract an extra fee.

Please provide agreed source files, information and feedback on time. If essential input is delayed, we will discuss a reasonable revised schedule. Following a reminder, a project may be placed on hold if required input remains outstanding 30 calendar days after I requested it. A hold is not an automatic cancellation or loss of your deposit. New work, rush requests or significant changes require an agreed written variation before additional charges apply.

Finished remote music files will ordinarily be delivered through an appropriate private sharing method. Please download and back them up promptly; I do not promise indefinite storage or recovery.

Recording, music rights and credits

Ownership and permitted uses of original compositions and finished master recordings are separate matters. Unless otherwise agreed in writing, I generally retain copyright in original compositions I create and license them for the specifically agreed project and uses, subject to co-writers and other rights. Ownership of a commissioned master recording will be identified in the project agreement, taking account of Australian copyright law. Exclusivity, buyouts, significant remixes and unrelated reuse need separate agreement where applicable.

Any songwriting share arising from a session-guitar contribution is discussed and agreed for that project; playing a session part alone does not automatically create a songwriting share. Composer or performer credits are agreed where relevant, respecting applicable moral rights. Ordinary accurate crediting does not imply I endorse a client's business. Separate approval is needed for promotional use of my photographs, recognisable likeness, logo or any claim of personal endorsement.

Clients must tell me about any copyright restrictions affecting supplied material. Covers, samples, third-party compositions, existing recordings, arrangements, synchronisation and public performance can require different permissions. We will agree who obtains relevant clearances for the intended use; I remain responsible for the legal obligations applying to my own work. I use licensed third-party tools and sound libraries only within their applicable permissions.

Confidentiality and portfolio examples

I treat unreleased client work and project details confidentially. I seek approval before sharing identifiable confidential material with outside creative collaborators. I will not publish a client's recordings or identify a private project in my portfolio without specific written approval for that example. My completed client music does not include generative-AI-produced musical compositions or performances, and I do not upload confidential unreleased client material to external generative-AI services.

Live performances and online lessons

For live bookings we agree the location, playing time, sets and breaks, access, sound equipment responsibilities, repertoire, travel expenses and relevant music-licensing arrangements in writing. Changes to duration, venue, date, equipment or special requests must be discussed and any extra cost approved beforehand. I will not perform where conditions are unsafe.

Online guitar lessons are provided personally by David, using a suitable video service agreed before booking. For students under 18, a parent or legal guardian must approve the booking and reasonable safety arrangements. Lessons are not automatically recorded; separate consent is required for any recording.
